Acceptance of these terms

These Terms of Service govern your access to and use of OmniLux websites, applications, plugin materials, marketplaces, cloud-connected services, and related features made available by OmniLux.

By creating an account, joining a waitlist, purchasing a subscription, or otherwise using OmniLux, you agree to these Terms and our Privacy Policy. If you are using OmniLux on behalf of an organization, you represent that you have authority to bind that organization.

Eligibility and accounts

You must provide accurate information and keep your account details current. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials.

OmniLux may suspend or terminate access if we reasonably believe an account is being used unlawfully, abusively, fraudulently, or in a way that threatens the security or stability of the service.

Permitted use

You may use OmniLux only in compliance with applicable law, these Terms, the Acceptable Use Policy, and any additional product-specific terms provided at signup, checkout, or within the service.

  • Do not attempt unauthorized access, interfere with service operation, reverse engineer restricted systems, or bypass security controls.
  • Do not upload, distribute, or link content that infringes intellectual property rights or violates the law.
  • Do not misuse plugin, integration, or API materials in a way that harms OmniLux, its users, or third parties.

Third-party services and content

OmniLux may integrate with or display materials from third parties, including authentication providers, payment processors, plugin authors, and metadata or artwork providers such as TMDB.

Third-party services operate under their own terms and privacy policies. OmniLux is not responsible for the availability, accuracy, or practices of third-party services that you choose to use through OmniLux.

User content, media libraries, and provider materials

You retain whatever rights you have in materials you submit, import, connect, or make available through OmniLux. You grant OmniLux the limited permission needed to host, cache, transmit, display, analyze, secure, support, and otherwise process those materials as needed to provide the service, operate requested features, comply with law, and enforce these Terms.

You represent that you have the rights and permissions needed for any media, metadata, artwork, plugin package, provider material, organization material, or other content you submit or connect. OmniLux may remove, disable, quarantine, or restrict materials or access when required by law, rights-holder request, security review, abuse review, provider contract, or service integrity needs.

Billing and refunds

Paid subscriptions, if offered, are billed in advance on the schedule shown at checkout and renew automatically until canceled. Pricing, taxes, billing intervals, included features, and any promotional terms shown during checkout control for the purchase you make.

Stripe processes checkout and billing on OmniLux’s behalf. By purchasing a paid plan, you authorize OmniLux and Stripe to charge the payment method you provide for subscription fees, taxes, and other amounts clearly disclosed at checkout.

Unless a plan, written order, or applicable law states otherwise, payments are non-refundable after the relevant billing period begins. If you believe a charge was made in error, contact [email protected] promptly and we will review the request. The Refunds and Cancellation page describes the beta checkout posture in more detail.

Availability and changes

OmniLux is evolving. We may add, change, suspend, or remove features, integrations, pricing, or access tiers at any time, including during private or early-access periods.

We will use reasonable efforts to provide notice of material changes when required by law or when the change materially affects active paid subscriptions.

Intellectual property

OmniLux and its licensors own the service, branding, software, site content, and related intellectual property, except for content or materials owned by users or third-party providers.

These Terms do not grant you ownership of OmniLux intellectual property. You receive only the limited right to use the service as expressly permitted by these Terms.

Disclaimers and liability limits

To the maximum extent permitted by law, OmniLux is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the maximum extent permitted by law, OmniLux will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data. Our total liability for claims arising from these Terms or the service will not exceed the greater of the amount you paid OmniLux in the twelve months before the claim arose or one hundred U.S. dollars.

Termination

You may stop using OmniLux at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if continued access creates unacceptable legal, security, or service risk.

Sections that by their nature should survive termination, including billing obligations, ownership, disclaimers, liability limits, dispute provisions, and other protective terms, will survive.
